User shall use the Coastalhabitats.com system solely for their own use and shall not allow others to use the Coastalhabitats.com system under or through that user's login ID/email and password.

Indemnity:

As a condition of use of this site and/or The Habitats Network, L.L.C.'s services, you agree to indemnify The Habitats Network, L.L.C. including its owners, officers, employees, suppliers, distributors, participating Lenders, or real estate professionals from and against any and all liabilities, expenses (including attorneys' fees) and damages arising out of claims resulting from your use of Coastal habitats or The Habitats Network, L.L.C. services, including without limitation any claims alleging facts that if true would constitute a breach by you of this agreement.

Other Conditions:

This Agreement constitutes the entire agreement between the parties, and no verbal agreements or representation changing or supplementing in any manner the Terms and Conditions hereof shall be deemed effective. All issues relating to this agreement will be governed by the laws of the State of Texas applicable to contracts to be performed entirely therein, and venue for any and all disputes is deemed to be Harris County, Texas. Any dispute arising under this Agreement may be resolved either in court, or by arbitration at The Habitats Network, L.L.C.'s discretion.   The Habitats Network, L.L.C. reserves the right to modify or update this agreement as necessary.  Any revisions to this agreement will be posted under the “Terms & Conditions”  or “Use of Site” on The Habitats Network, L.L.C.’s web venue.  Once posted any revisions become immediately effective. It I the user’s responsibility to review the term and conditions prior to entering into any The Habitats Network, L.L.C.’s web venues.

The parties agree that if any of the covenants, obligations, agreements, or restrictions in this Agreement are held to be invalid by a court of competent jurisdiction, such holding will not invalidate any of the other covenants, obligations, agreements, or restrictions, it being intended that the covenants, obligations, agreements, and restrictions contained herein will be severable and that the invalidity of one will not invalidate any others.

Articles, pronouns, and other terms used herein will be construed to include masculine, feminine, plural, and singular forms so that form, case, or gender will in no way limit the interpretation of Agreement.

Failure to enforce any provision contained herein in no way acts as a waiver of that right.

As a condition of your use of this Site, you warrant to The Habitats Network, L.L.C. that you will not use this Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. If you violate any of these terms, your permission to use the Site automatically terminates.

The Habitats Network, L.L.C. prohibits the use of our system or its tools to generate or send unsolicited commercial email (spam).
